right' to deface a car with spray paint, defendant tells
judge at sentencing

April 17, 2007 | LOGAN -- When asked by 1st District
Court Judge Gordon J. Low what she thought about buying
spray paint and defacing someone's car, the defendant
responded, "I'd think it's right."
Jessica Ortiz, the defendant, was sentenced Monday
to 60 days in the Cache County Jail.
Accused of committing the crime of spray-painting
someone's car Dec. 21, 2006, Ortiz was charged with
a third-degree felony of criminal mischief. She spent
three days in jail, which will count toward her sentence
as agreed upon by Judge Low.
Her attorney, David M. Perry, asked for probation instead
of time in jail because of Ortiz having a job and a
baby. The state attorney recommended no probation because
of a juvenile criminal record including interfering
with an arrest and possession of a controlled substance.
Judge Low agreed with the state and sentenced Ortiz
to jail time, but she wasn't taken into custody Monday
because she had to work. Judge Low gave her until 5
p.m. Tuesday to report for jail.
Also part of the sentencing was paying restitution
for the damages of $2,400, completing therapy classes
for parenting skills and aggression, and a $1,000 fine.
