City subdivision includes annexation

February 19, 2008 | BRIGHAM CITY -- The City Council
has approved plans for a 128-lot subdivision on the
far north end of Brigham City. Part of that plan includes
a petition to the county to annex a small portion of
county land into Brigham City limits. The land to be
annexed is owned by Kotter Canyon Estates, LLC.
The Kotter Canyon subdivision is located on the east
side of Highway 38, between 900 North and 1500 North.
In the original plat submitted to the city for consideration,
the entire subdivision would have fit within the existing
boundaries. However, the Army Corps of Engineers required
the developers to push the subdivision to the east,
because a small piece of land in that reqion is designated
as wetlands.
By doing so, there are six lots on the far east side
of the subdivision that extend into the county.
The agreement signed by the city allowed the subdivision
to be accepted, giving the developers six months to
work through the annexation process.
The county recorder's office has reviewed the plat,
and a deed restriction will be placed on the six lots.
Homes cannot be built on them until the annexation has
been approved. The annexation process must be complete
by June 1 or the county will require Brigham City to
remove those lots from the plat.
This agreement allows the developers to begin work
on the site immediately instead of waiting until later
this summer.
